OVERVIEW

Found a property you want to purchase and verified the documents. Now the documents are to be registered for conservation of evidence, assurance of title, publicity of document and preventing the fraud. All the documents are recorded with registering officer and preservation of copies of original document. The registration process is mandatory for each type of immovable property dealing with the transactions of property. The documents that need to be registered is present by the concerned person himself/herself or by the person working as authorized representative or agent of the concerned person.

Type of document for registration-

There are two type of documents that are to be registered as per requirement.

1) Compulsory registration-

a) Instruments of gifts of immovable property

b) Non – testamentary instrument or sale of immovable property whose value is exceeds Rs 100

c) Lease of immovable property exceeding 1 year

d) Non – testamentary instrument transferring or assigning any decree or order of a court or any award

2) Optional registration-

a) Will Rent agreement or lease for period of 11 month

b)Document of past transaction

c) Court order comprising an immovable property below Rs 100

d) Certificate of sale granted

e) Agreement of mortgage

f) Promissory note

g) Instrument of partition by revenue officer

h) Grant of immovable property by the government

Penalty -

The document that are to be registered should be presented within four months of their execution along with required fees.

After the set time limit expires the application to the sub- registrar is to be made regarding the delay and then the registrar may agree to register such document after the payment of fine that extend to 10 times the value of registration fee within next four month.

    • Id proofs of parties (buyer and seller)

    • Passport size photo of parties

    • Sale deed signed

    • Power of authority for the person representing someone else

    • Patta passbook

    • Application of Patta transfer

    • Pan card

    • Stamp duty signed and registration fee
